Do Not Call Compliance Issues

This is from a series of Q&As from the FTC about the Do Not Call law. This part is about compliance. The FTC is serious about this law and have been handing out large penalties ($11k PER violation). Call 100 people illegally and you can add up a big bill quickly. Why waste your time calling someone who doesn't want to talk to you and put your company at such great risk?

28. What happens to companies that don’t pay for access to the registry?

A company that is a seller or telemarketer could be liable for placing any telemarketing calls (even to numbers NOT on the registry) unless the seller has accessed the registry and paid the fee, if required. Violators may be subject to fines of up to $11,000 per violation. Each call may be considered a separate violation.

29. What if I call a number that’s not on the registry without checking the registry first?

It’s against the law to call (or cause a telemarketer to call) any number on the registry (unless the seller has an established business relationship with the consumer whose number is being called, or the consumer has given written agreement to be called). But it’s also against the law for a seller to call (or cause a telemarketer to call) any person whose number is within a given area code unless the seller first has subscribed to and accessed the portion of the registry that includes numbers within that area code, and paid the annual fee, if required.

In addition, it’s against the law for a telemarketer, calling on behalf of a seller, to call any person whose number is within a given area code unless the seller has first subscribed to and accessed the portion of the registry that includes numbers within that area code, and paid the annual fee, if required. Telemarketers must make sure that their seller-clients have paid for access to the registry before placing any telemarketing calls on their behalf.

30. What’s my liability if my company inadvertently calls a number on the registry?

The TSR has a “safe harbor” for inadvertent mistakes. If a seller or telemarketer can show that, as part of its routine business practice, it meets all the requirements of the safe harbor, it will not be subject to civil penalties or sanctions for mistakenly calling a consumer who has asked for no more calls, or for calling a person on the registry. To meet the safe harbor requirements, the seller or telemarketer must demonstrate that:

it has written procedures to comply with the do not call requirements
it trains its personnel in those procedures
it monitors and enforces compliance with these procedures
it maintains a company-specific list of telephone numbers that it may not call
it accesses the national registry no more than 31 days (starting January 1, 2005) before calling any consumer, and maintains records documenting this process
any call made in violation of the do not call rules was the result of an error.

I have signed up for the Do NOT Call over a month ago and since then I get more calls now than before. I am getting a call every other day from James at T.V. Satelite and would like to be removed from there list. How do I go about that? I am also getting lots of calls from Dish Network and Direct T.V. Please help! Thank You

I'm getting emails (dated 10/15) that all cell phone numbers are being released to telemarketers tomorrow. Is that true? I'm also being told that by calling from the cell phone to the Do Not Call Number, that bars telemarketers from calling that cell phone number. Is that true?

How do I change my password? The FTC recently changed service providers, and I was expecting an email from the FTC prompting me to change my password. I did not receive their email. I am unable to check names on the registry without this new password. Help!

I get at least three phone calls a day for medicine. They do not speak very good English. I have told them to please do no call me, but they still do. I have been on the computer and it will come up as a call from Turkey, the number with it is +90633. This morning I received another call and it said Operator +190633, Marquette, MI. How can I get these people to stop calling me?

Over the past year and half we have received almost daily sales calls from the Dish Network (Echostar Communications Co) even though our home phone number has been listed on the National Do Not Call Registry and the Texas DO Not Call Registry for the past three years. We have told the Dish Network caller repeatedly that they have violated the do not call law. They seemed not to care at all. In fact they seemed to be foreign based (in China) and didn’t even know such a thing as a do not call list. For the first year, we reported each incident to the National Do Not Call Registry website. Nothing happened. We received no feedback or inquiry from the National Do Not Call Registry. The calls from the Dish Network kept on coming. In December of 2006, we filed a complaint with the Better Business Bureau of Denver (BBB). Dish Network responded to this complaint. A woman from the TCPA department of the Echostar LLC called me and requested me to set up a sting operation to catch the caller. I agreed. The woman gave me a fake SS# and a Visa card#. I did the sting operation the next day on the new Dish Network caller. The Dish Network person sent a letter to me and BBB informing us that they did an investigation based upon the sting operation and was able to identify the caller as someone from a company based in Maryland called Total Marketing Solutions. In the letter Dish Network promised that no more calls starting February, 2007. Yet, right after this letter, the call kept on coming until today. I called the woman in the Dish Network headquarters and told her that there were new calls and I did additional sting operations on the new callers. I asked her to investigate. She never did. Apparently they did the investigation after the first sting operation just to be able to send that letter to BBB to close the case. Once the case was closed, they would do nothing to investigate the new calls even though they promised in writing of no new calls. After two months I couldn’t get any response from the woman in the Dish Network who set up the sting operation. I called another person in Dish Network whose name appeared in the letter to me and BBB. I was told that the woman I worked with had quit. I filed complaint with the Texas Department of Consumer Protection, the Colorado Department of Consumer Protection, the FTC, and the FCC. None of they seemed to be able to do or did anything to stop the Dish Network from violating the do not call list. In the middle of 2007, I had enough and filed a second BBB complaint. Again, Dish Network responded to the complaint by doing another trace on one of a dozen or more of the sting operations I did. They reported the caller as one company based in California in another letter to BBB and me. Again Dish Network promised to stop the calls after July of 2007. Yet the calls kept on coming. I refused to close the second BBB complaint and insisted that Dish Network explain what they had done and would do to these law breakers and what measures they would take to make sure the calls would stop. Dish Network ignored my requests. After a while BBB closed the case and informed me that there was nothing more they could do since BBB had no enforcement authority. It seems to me that the Do Not Call list has no teeth at all. A company like Dish Network can simply ignore it and get away with it with abandon. Recently, we are getting calls every evening from Dish Network at 7:10 PM CST like clockwork. I am pretty sure it is an automated calling setup that just cycling through a phone list. I don’t know what I can do to stop them.

In the past week I have received at least one call a day from Custom Response 14022232165. There is never anyone on the line and when I try to call back to the number on my caller ID I get a busy signal. I resent this intrusion of my privacy when I could be doing something else and my invalid wife is usually awakened by this useless call. What purpose does it serve? What can I do about it? I'm on the do not call lists and have just renewed it.

I have asked AIRTEL through SMS to 121, not to send any commercial adds to my cell phone through SMS & AIRTEL has registered my advice vide no.S1000439140 dated 16.10.2007. But since then more & more SMS are being sent, 99% of whitch are from AIRTEL. I require urgent help.

What good does it do to get on the do not call list!!! I'm still getting calls everyday!!! The same company has called me 3-4 times a day! each time I ask them to not call! I've told them they know NOTHING about my car or it's warranty! AND I have told them I am on the DO NOT CALL LIST! The company name is: ONE NATIONAL! You people are Giant Pests!!
